Data Ownership
Hyphen Solutions' policy does not explicitly state "data ownership" in the traditional sense but implies that users have control over their personal data. The privacy policy indicates that users can manage their personal information, suggesting a level of personal control over data that aligns with data ownership principles.
Data Portability
Hyphen Solutions provides clear guidelines on data portability, which is the ability of users to move their data from one platform to another. This is particularly relevant under regulations such as the GDPR (General Data Protection Regulation) for users within the European Union. Here are the key aspects of their data portability policy:
Right to Access and Transfer Data: Users have the right to access their personal data and obtain it in a structured, commonly used, and machine-readable format. This facilitates the easy transfer of data to another system.
Request Fulfillment: Users can request their data by contacting Hyphen Solutions directly through specified communication channels (e.g., email). The company commits to providing the requested data within 30 days of the request, ensuring timely access to personal data.
Handling Third-Party Data: If personal data has been shared with third parties, Hyphen Solutions will notify these parties of any rectifications or restrictions placed on the data as requested by the user. However, Hyphen notes that they are not in a position to audit these third parties to ensure the execution of these requests.
Hyphen HomeFront is designed to be scalable, accommodating the changing needs of organizations as they grow or downsize. The software's open platform and integration capabilities allow for easy expansion or reduction of features and modules based on the company's requirements. This flexibility ensures that businesses can adjust their usage and costs in line with their operational needs. Specific terms for scaling up or down, such as pricing adjustments or contractual obligations, would typically be outlined in the service agreement with Hyphen Solutions.
Contract Renewal
Automatic Renewal: Contracts with Hyphen Solutions, including those for Hyphen HomeFront, may automatically renew for successive terms unless cancelled by either party. This is a common practice in software service agreements to ensure uninterrupted service.
Renewal Term: After the primary term of the agreement, the contract may renew for successive one-year periods unless either party provides written notice of non-renewal at least sixty days prior to the expiration of the term.
Annual Fee Increase: Hyphen Solutions has a policy of implementing an annual increase of 5% for each fee under the agreement, including license and maintenance fees. This increase takes effect upon the primary term's completion and applies to any renewal term.
Contract Cancellation
Termination Without Penalty: If a subscriber does not agree with changes made by Hyphen Solutions, they may terminate the contract without penalty. In such cases, the subscriber will be reimbursed the subscription fee for the remaining period
Termination for Convenience: Customers may terminate their agreement with Hyphen Solutions, without cause, upon thirty (30) days written notice.
Termination for Cause: The agreement may be terminated immediately by either party for several reasons, including if the other party files for bankruptcy, breaches the agreement, or if continuation of service may subject the terminating party to undue financial, legal, regulatory, or reputational risk.
Effect of Termination: Upon termination, parties are required to discontinue use of the other party’s confidential information, delete or return all copies of such information, and settle any outstanding payments.
Accrued Obligations: Termination of the agreement does not release the parties from any liability which has already accrued or which may accrue with respect to any act or omission before termination
Hyphen HomeFront software, as part of Hyphen Solutions' offerings, meets various compliance standards to ensure data security and regulatory adherence.
SOC 1 Compliance: Hyphen Solutions ensures that their software, including HomeFront, adheres to SOC 1 compliance standards. This compliance is crucial for safeguarding financial data, which is particularly relevant for software that integrates with multiple accounting systems and handles sensitive financial transactions.
Integration with Compliant Accounting Systems: Hyphen HomeFront integrates directly with several accounting systems known for their compliance standards, including Sage 300 Construction and Real Estate, Sage Intacct Construction, Sage 100 Contractor, QuickBooks, and Xero. These integrations suggest that HomeFront is compatible with and supports compliance requirements relevant to these systems.
